ORAL ORDER

2 05-02-2026 Heard learned counsel for the petitioners, learned

counsel appearing for the respondent- State and learned counsel

for the respondent- University.

2. The petitioners in the present writ application has

prayed for granted of following reliefs:-

(i) “That the petitioner prays for issuance

of an appropriate writ, order or direction

to the respondent authority to pay arrears

of salary of termination period since

06.06.20212 to 02.12.2023, it deems the

petitioners their legitimate claim to salary

for the period from the date of his

termination till the date of his

reinstatement in service, which is arbitrary,

discriminatory and violative of Article 14

and 21 of the Constitution of India.

(ii) It is further prayed that this Hon’ble

Court be pleased to grant any other reliefs

for which petitioner is found entitled and

an appropriate writ/ writs/order/orders or

direction/directions may be issued the

given facts and circumstances of the case.”

2. Learned counsel for the petitioners were advancing

the argument that similarly situated person have been granted

the benefit of arrears of salary for the period of termination

but the petitioner has not been granted the same relief.

3. Learned counsel for the respondent-State submits

that a counter affidavit would be required to be filed in the

present case.

4. As prayed for, four weeks’ time is granted to the

respondent-State to file a counter affidavit, giving para-wise

reply to the averments made in the writ application.

5. A copy of the same should be served in advance

upon the learned counsel for the petitioners, who may file a

reply/ rejoinder to the same within a further period of two

weeks’ if they so desire.

6. Put up this matter on 02.04.2026.
