2 12-02-2026 Heard learned counsel for the petitioner and learned counsel for the respondents-State.
2. In the present writ application the petitioner has prayed for the grant of following reliefs:
“(i) For a writ in the nature mandamus commanding the respondent to shift the date of promotion of the petitioner in the rank of Inspector from 12.08.2016 to 23.01.2014 as the ground for withholding the promotion on account of punishment awarded in the disciplinary proceeding, no longer exist and survive as the same has been quashed and thus, the petitioner is entitled for promotion with effect from the date his juniors have been promoted and grant of all consequential and monetary benefits to the petitioner.
(ⅱ) For a writ of mandamus commanding the respondent to hold a review Departmental Promotion Committee for promotion of the petitioner to the rank of Deputy Superintendent of Police consequent to such shifting of the date of promotion in the rank of Inspector with effect from 23.01.2014, as then the petitioner would have been entitled for promotion to the rank of Deputy Superintendent of Police with effect from 2019 as juniors to the petitioner have been promoted to the rank of Deputy Superintendent of Police with effect from 2019 and grant of all consequential and monetary benefits to the petitioner.
(iii) For any other relief /
reliefs to which the petitioner is found entitled in the facts and circumstances of the case.”
3. At the outset, learned counsel appearing for respondent-State draws the attention of this Court of paragraph- 15 of the counter affidavit filed by respondent no.8 i.e. the Superintendent of Police, Katihar, in which it has been stated as follows:
“15. That the Superintendent of Police, Katihar is not the competent authority to shift the date of promotion of the petitioner from 12.08.2016 to 11.07.2014 and the Police Headquarter/Home Department is competent authority to take the decision with regard to claim of
4. In view of the above statement made in paragraph-
15 of the counter affidavit filed by respondent no.8, the respondent no.2 i.e. the Additional Chief Secretary-cum- Principal Secretary, Department of Home, Government of Bihar, Patna is directed to file a counter affidavit giving parawise reply to the averments made in the writ application. A copy of the counter affidavit shall be served in advance to the learned counsel appearing for the petitioner, who may chose to file a reply/rejoinder to the same within further period of two weeks, 5. Put up this case on 09.04.2026.
