2. This application, for grant of anticipatory bail, arises out of Wazirganj Police Station Case No. 13 of 2025, dated 10.01.2025, disclosing offences punishable under Sections 126/115(2)/303(2)/74/76/352/351(2)/3(5) of the

The prosecution case, as per the First Information Report, is that on 07.01.2025, at about 6 PM, the petitioners, along with other co-accused persons, came to the house of the informant and started assaulting the informant and his family members by lathi, danda and iron rod. When the sister and aunt of the informant came to their rescue, the petitioner no. 2 caught hold the hair of the sister of the informant and tried to outrage her modesty. The petitioners, along with others, also snatched cash Rs.

18,000/- and silver chain.

4. Learned Counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this false case due to previous land dispute. He further submits that both parties are closely related and there is case and counter case between the parties. He further submits that there is three days unexplained delay in lodging the First Information Report. He further submits that no person from the side of the informant has sustained any injury, which would be evident from the impugned order itself.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that both parties are closely related, there is previous land dispute between the parties, case and counter case is also there and none has sustained any injury, which would be evident from the impugned order itself, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya, in connection with Wazirganj Police Station Case No. 13 of 2025, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha (Anil Kumar Sinha, J.)
