5 09-02-2026 Heard learned counsel for the petitioner as well as learned counsel for the State.

2. Issue notice to the opposite party no. 2 by both modes, i.e., under registered cover with A/D as well as through ordinary process for which requisites etc. must be filed within two weeks, failing which the present petition will be dismissed.

Learned counsel for the petitioner submits that the present petition has been filed challenging the order/judgment Judge-IV, Patna City, Patna, in Criminal Appeal No. 91 of 2022 whereby and whereunder the learned appellate court confirmed the judgment of conviction and order of sentence dated Magistrate, Patna City, in Trial No. 5003 of 2022 arising out of Complaint Case No. 406 of 2014, in which the petitioner along with other co-accused persons were convicted and sentenced. Learned counsel further submits that the petitioner was sentenced to undergo simple imprisonment for three years with fine of Rs. 10,000/- for the offence punishable under Section 498A of IPC and further to undergo simple imprisonment of two years with fine of Rs. 10,000/- for the offence under Section 4 of the Dowry Prohibition Act. Both the sentences were directed to run concurrently and in default of payment of fine, the petitioner was directed to further undergo simple imprisonment of six months. Learned counsel further submits that the petitioner, who is the husband of the opposite party no.2, is in custody since 15.07.2025 and he has already remained behind the bar for more than six months. Learned counsel prays for suspension of sentence of the petitioner and release him on provisional bail during the pendency of this revision petition.

Having regard to the submission made on behalf of the petitioner, during the pendency of this revision petition, let the sentence, imposed upon the petitioner, be suspended and he be released on provisional bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna City, Patna, in connection with Complaint Case No. 406 of 2014, subject to the condition that one of the bailors will be the close relative of the petitioner.
