The court asserts that admissions should not be invalidated without clear state authority guidelines, ensuring the validity of recognized qualifications.

The petitioner, who successfully passed her matriculation examination in the year 2022 from the Bihar School Examination Board, Patna completed her vocational training (N.C.V.T.) and State Council for vocational training course, which is held equivalent to the intermediate, in terms with Memo No. 09 dated 09.07.2018, issued under the signature of Deputy Secretary, Education Department, Government of Bihar, Patna.

After having completed the aforenoted course, the petitioner also appeared in the examination of 12^th/intermediate conducted by Bihar School Examination Committee Patna and Industrial Training Higher Secondary Level Language Examination, 2024 for the subject of Hindi and English and successfully passed the examination and obtained the certificate.

Having obtained the 12^th pass certificate, she appeared in the examination of JEE (Main), 2025 and according to the percentile obtained in the examination, a certificate has also been issued in her favour under the signature of Director, National Testing Agency. The petitioner was allowed to appear in counseling duly conducted by Bihar Combined Entrance Competitive Examination, Board and allotted Electrical Engineering Degree Course for the Session 2025-2029 in Government Engineering College, Banka.

5. The petitioner appeared before the College, in question, and after proper verification of the documents, she was admitted in the college on submitting the admission fee. The petitioner pursued her course of Bachelor of Engineering Course and appeared in the classes regularly. However, all of a sudden, when the date of registration of the said course had been declared, she was not allowed to submit her registration form. On query, it has been informed that the 12^th/intermediate degree obtained by the petitioner is not valid for pursuing the course.

This Court is surprised to see that once a candidate has been allowed to appear in the examination and after proper counseling and verification of the certificates, once she has been admitted in the college, in question, can the college take a decision not to accept her registration form without seeking guidelines from the State authorities, who are the only competent to satisfy the query of the college. All the more, once the Education Department, Government of Bihar has made it clear that the course conducted by the petitioner from National Council for vocational training and State Council for vocational training course is equivalent to intermediate.

7. Let a counter affidavit be filed on behalf of the State respondent especially respondent nos. 5 and 6, preferably within a period of three weeks, from today.

8. In the meantime, notice be also issued to the respondent nos. 11 and 12 under both processes i.e. ordinary process as well as registered cover with A/D, for which requisites etc. must be filed within a period of one week.

9. Let the matter be placed on 19.02.2026, within top five cases.

10. Considering the fact that, till date, there is no decision with regard to cancellation of her candidature or admission, the petitioner shall be allowed to appear in her ongoing classes and fascilitate the process of registration, if going on, which shall be subject to the final outcome of the writ petition.
