Compliance with court orders is mandatory, and deliberate disobedience may result in contempt proceedings.

In compliance with the order of this Court, a supplementary show-cause affidavit has been filed on behalf of the Director, Primary Education, Education Department, Government of Bihar (opposite party no.3) with the averments that necessary actions have been taken and the petitioner has been paid certain amount under Group Insurance Scheme, General Provident Fund, Leave Encashment as well as Gratuity.

3. It is further stated that the petitioner has been allowed provisional pension till September, 2025. The concerned opposite party further vide Memo No. 682 dated 15.09.2025 has requested the office of the Accountant General to issue sanction order in favour of the petitioner for payment of full pension and gratuity enclosing the pension papers and original service book of the petitioner.

4. Learned Advocate for the petitioner submits that besides the fact the petitioner has not been allowed salary for the month of December, 2016 and January, 2017. Even the provisional pension of the petitioner has been stopped after September, 2025 and, in fact, all the pensionary benefits, which have been mentioned in the supplementary show-cause affidavit, is confined to 90% of the entitlement of the petitioner.

5. Having heard the parties and on perusal of the materials, this Court is not satisfied to the supplementary show- cause affidavit, filed on behalf of opposite party no.3; inasmuch as till date the order of this Court has not been given effect to its letter and spirit.

In the aforesaid facts, this Court further directs the opposite party no.3 to ensure compliance of the order of this Court in its letter and spirit and ensure payment of all the admissible amount under all the heads preferably within a period of four weeks, failing which the Director, Primary Education, Education Department, Bihar (opposite party no.3) shall file a personal affidavit as to why not a contempt proceeding be initiated against him for his willful and deliberate disobedience of the order of this Court.
