4 03-02-2026 Heard learned counsel for the appellants and learned APP for the State.
2. Learned counsel for the appellants is pressing the prayer, as made in the memo of appeal, for suspending the execution of sentence and release of the appellants on bail during pendency of the appeal submitting that the appellants have been convicted under Sections 20(b)(ii)(c), 23(c) and 29 of the NDPS Act, 1985 and they have been sentenced to R.I. for 10 years and fine of Rs. 1,00,000/- under each Section and in case of default of payment of fine, they were directed to undergo further rigorous imprisonment for one year under each Section and all the sentences are directed to be run concurrently.
3. Learned counsel for the appellants further submits that out of total sentence as awarded against the appellants, they have already served about three years eleven months and seventeen days since 16.02.2022. He also submits that the impugned judgment of conviction and order of sentence dated 30.05.2024 and 31.05.2024 respectively, passed by learned Exclusive Special Judge, NDPS, Bettiah, West Champaran in Sessions Case No. 28 of 2022, arising out
