2 28-01-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 476 of 2025 dated 09.09.2025, instituted for the offence punishable under Sections 108 , 80, 238, 3(5), 137(2), 140(3) of the Bharatiya Nyaya Sanhita, 2023 .
3. The prosecution case, in short is that the informant has suspicion that the petitioner along with Narendra Kumar (husband of the deceased) and other co-accused persons had killed Khusbu Kumari. It is further alleged that the petitioner has love affair with the husband of Khusbu Kumari (deceased).
4. Learned counsel for the petitioner submits that the petitioner is innocent and she has been falsely implicated in this case. It is further submitted that the petitioner is a young lady and an employee of the husband of the deceased. It is next submitted that the petitioner is neither the relative of the deceased nor she has any concern with the said incident. It is next submitted that only on the basis of self confessional statement of the petitioner, she has been made accused in this case. There is no specific allegation against the petitioner rather the specific allegation is against the husband of the deceased namely, Narendra Kumar. Except the self confessional statement of the petitioner, there is no material against the petitioner to connect her in the said crime. Lastly, it has been submitted that the petitioner is in custody since 13.09.2025, having no criminal antecedents and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- IIIrd, Barh, Patna in Bakhtiyarpur P.S. Case No. 476 of 2025.
