2. Records have been placed before this Court to consider the prayer of the appellant for suspension of his sentence and release on bail during pendency of the appellant.

3. The appellant has been convicted vide judgment dated 28.02.2025 and sentenced vide order dated 28.02.2025 in T.R. No. 05 of 2021, Reg. No. 827/2022 arising out of Ujiyarpur P.S. Case No. 38 of 2021 passed by learned Exclusive Special Judge (Rape and POCSO), Samastipur, for the offence punishable under Section 376 of the Indian Penal Code , Section 6 of the POCSO Act and Section 9 of the Prohibition of Child Marriage Act, 2006 . He has been ordered to undergo rigorous imprisonment of twenty years with a fine of Rs.5,000/- for the offence under of the POCSO Act and in default of payment of fine, he shall further undergo rigorous imprisonment for three months.
