The court emphasized the right to anticipatory bail under the SC/ST Act when similar co-accused receive bail, considering the clean antecedents of the appellants.
Headnote:This judgment concerns the grant of anticipatory bail under Section 14A(2) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The facts reveal a serious incident of alleged assault with firearms, where certain appellants sought bail after their prayer was rejected by the lower court. The court found merit in the argument that the appellants bore clean antecedents, and that similar co-accused were granted bail under similar circumstances. The primary issue addressed was the appellants' involvement in the alleged planning and commission of the attack based on caste sentiments. The court ultimately allowed the appeal and set aside the previous order denying bail, permitting the appellants to be released on bail upon satisfies conditions.
