PATNA HIGH COURT

The State of Bihar through the Principal Secretary, Revenue and Land Reforms Department, Govt. of Bihar – Respondent
Civil Writ Jurisdiction Case No.6356 of 2021

Advocates:
For the Appellants/Petitioners:Mr. Jitendra Prasad Singh, Sr. Advocate, Mr. Varun Krishna Singh, Advocate
For the Respondents:Mr. Rajiv Ranjan Kumar Pandey, Advocate

A tribunal's decision is unsustainable due to quorum issues, necessitating reconsideration by the proper authority.

Headnote:The judgment concerns the petitioners' challenge to the order dated 29.01.2020 by the Bihar Land Tribunal which dismissed their case. The Court found insufficiency in the quorum leading to the decision, necessitating a reconsideration by the Judicial Member as per the ruling in State of Gujarat Vs. Utility Welfare Association. Ultimately, the Court quashed the earlier order for being unsustainable and remitted the case for proper adjudication. The matter is remitted back to the Bihar Land Tribunal for its reconsideration by proper quorum, which is required to be chaired by the Judicial Member.
