2. The petitioner seeks bail, who is in custody since

21.07.2023 in connection with Rail P.S. Muzaffarpur No. 243 of 2023, (Session Trial No. 938/2023) F.I.R. dated 20.07.2023 for the offences punishable under Sections 304 , 379, 356/34 of the Indian Penal Code .

3. According to prosecution case, accused-petitioner is alleged to have looted the purse of one Soni Kumari, containing Aadhar Card, Travelling Ticket and other articles and dashed her from the train, as a result she died on the spot.

Learned counsel for the petitioner submits that petitioner has clean antecedent and the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R.
