6 13-01-2026 Heard Mr. Sanjeev Ranjan, learned counsel for the petitioner duly assisted by Ms. Shrishti Singh and learned counsel representing the State as also learned Senior Counsel representing the respondent no. 1 to 3.

2. The present petition has been preferred for the grant of following relief(s):

“for issuance of an appropriate writ, order or direction to quash the order dated 4.11.2015 passed in BLDR Appeal No.329/2012 by the Divisional Commissioner Munger Division, Munger whereby he has directed the cancellation of Jamabandi recorded in the name of the petitioners, as illegal and wholly without jurisdiction as the dispute could not have been decided under the Bihar Land Dispute Resolution Act unless the description of land was covered by any of the six enactment. Secondly the appeal was barred by limitation and no petition was filed for condonation nor the delay was condoned to vest power in the Divisional commissioner to decide the appeal on merit. I.A. No. 03 of 2025 and I.A. No. 04 of 2026

3. The aforesaid two Interlocutory Applications have been preferred for substitution of names of late Shubhash Sharma and late Naresh Sharma ( respondent no. 1 and 3 respectively) who died on 07.07.2021 and 15.01.2023 respectively leaving behind legal heirs as under:

(I) Respondent No.1, Subhash Sharma is survived by;

(i) Rahul Kumar Sharma (II) Respondent No.3, Naresh Sharma is survived by;

4. While the other substitution petition has been preferred as there has been inordinate delay of 1560 days and

1002 days in filing the said petition.

5. The reasons have been assigned, which cause the delay and since there is no opposition, both the aforesaid Interlocutory Applications stand allowed.
