7 22-01-2026 In this case, pursuant to the order dated 11.12.2025, notices were issued on review application as also the Interlocutory applications. 2. As per the office notes:

Undelivered regd. Cover of opposite party no. 3 returned unserved (flag U3) upon refusal to receive the notice. Service report of ordinary notice not yet received.

Under the above facts and circumstances, notice upon opposite party no. 3 may perhaps deemed to be validly served upon refusal or any other order may perhaps be passed.

Undelivered regd. Cover of opposite pary no. 1(e) returned unserved (flag Ue) with postal peon’s report – ‘Absent’. Service report of ordinary notice not yet received.

Under the above facts and circumstance, steps for fresh service of notice upon opposite party no. 1(e) may perhaps be taken on present address or any other order may perhaps be passed.

3. In the aforesaid circumstance, notice upon opposite party no. 3 be deemed to have been validly served upon the refusal to accept the same.

4. Notice was earlier issued to the opposite party nos.

1(a), 1(b), 1(e), 2, 3 and proposed legal heirs of opposite party no. 1(c).(i).

5. As per the office report it has been personally served upon 1(c).(i) whereas opposite party no. 1(b), 2 and 3 have appeared through vakalatnama.

6. The ordinary notice of opposite party no. 1(a) has been received by his wife, Rupam Devi while ordinary notice of opposite party no. 1(e) has been received by the daughter, Tisa Kumari.

7. In the aforesaid background, the petitioner is required to file jointness petition showing relationship of the opposite party no. 1(a) with Rupam Kumari and 1(e) with Tisa Kumari.

8. I.A. No. 4/2025 and 5/2025 shall be taken up later.

9. Four weeks’ time is granted to do the needful failing which the application shall stand rejected without further reference to the Bench.

10. In case, the order passed is not complied and the matter accordingly stands dismissed, subsequently, the same be posted under the heading ‘To be Mentioned’.
