ORAL ORDER
6 30-01-2026 Heard Mr. Ajit Kumar, learned counsel for the
petitioner and Mr. Prasoon Sinha, learned Senior Counsel for
the Patna Municipal Corporation.
2. The present petition has been preferred for the
following relief/s:
(i) for initiating a Contempt proceeding and
thereafter punishing the Contemnor-
Opposite Parties for willful and deliberate
violation of the Order dated 11.7.2023

passed by this Court in C.W.J.C. No.925/18.
3. On 07.11.2025, this Court had taken note of the
fact that now demolition process has started after so may years
and in that background, in para-07 it was recorded as under:
7. Let the petitioner file an affidavit
on her present residential status and
shall also be filing a proper petition
before the Municipal Commissioner,
Patna Municipal Corporation, Patna
so that he can also take a decision on:
"(i) payment of rent if the
petitioner is residing under
tenancy agreement and/or;
(ii) to accommodate her in any
vacant flat of the PMC' till the
reconstruction is made;
(iii) while taking decision, they
shall be taking into account the
agreement that is standing
between the petitioner and 'the
PMC’.
4. Further, in para-08 of the order, the direction was

given to ‘the PMC; as under:
8. The PMC shall be filing fresh
affidavit on the development that shall
take place between 07.11.2025 to
15.01.2026.
5. ‘The PMC’ has now filed an affidavit stating that
the old building has completely been demolished, the matter has
been sent to the Empowered Standing Committee for approval
whereafter, construction work shall start.
6. The petitioner meanwhile, has filed supplementary
affidavit stating that she is staying in a rented (Flat no. 101,
block-A, Vijay Complex, Bazar Samiti Road, near Dr. R.C.
Ram Hospital, Patna). The details of the payment being made
to the landlady, Shakuntala Devi has been brought on record.
7. Since the matter is pending before the
Empowered Standing Committee, the Municipal Commissioner,
Patna Municipal Corporation has to take a decision on the
representation preferred by the petitioner or forward it to the
Empowered Standing Committee in view of the observation
made in para-03 of the present order as the order was passed in
the writ petition on 11.07.2023 and only after the contempt
petition was taken up, the Patna Municipal Corporation got

activated and steps are being taken.
8. As prayed for, list this case on 20.03.2026.
