2 17-02-2026 Heard Mr. Prasoon Shekhar, learned counsel for the petitioner and the learned APP for the State.

2. This application for grant of anticipatory bail arises out of Baikunthpur Police Station Case No. 263 of 2025 dated 20.07.2025, disclosing the offence under Sections 126(2), 115(2), 118(1), 109, 351(2), 352 and 3(5) of the BNS lodged by the informant, Narendra Singh.

3. As per the prosecution case, the informant alleged that the petitioner along with other accused persons, who are agnates of the informant, came and assaulted him with Farsa, Bhala and knife due to which he sustained injuries in his abdomen. Accordingly, the present FIR.

4. Learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged in the FIR and he has falsely been implicated in this case due to oblique motive. He further submits that the informant is said to have sustained four injuries and the injuries sustained on the vital part is not referable to this petitioner whereas the allegation against this petitioner is that the petitioner has caused injury on his left hand which is simple in nature. Learned counsel for the petitioner fairly submits that the petitioner has got two criminal antecedents out of which, one is of the year, 2013 in which, the petitioner has been acquitted of all the charges while in the second case being Baikunthpur PS Case No. 35/2025, the petitioner is on bail.

Considering the antecedents of the petitioner, it is accordingly, directed that in future, if any allegations are levelled against the accused-petitioner before the local police with regard to the threat and harassment being caused to the informant’s side, in such event, the local police would verify the allegations and on finding substance in the allegation, they would be at liberty to seek the cancellation of anticipatory bail, if granted to the petitioners.

6. On the other hand, learned APP opposes the prayer for anticipatory bail of the petitioner.

After having heard learned counsel for the parties and taking into consideration the fact that there is no specific allegation of overt-act against this petitioner, whereas the allegation against this petitioner is that he has caused injury on the left hand of the informant which is simple in nature, this Court is inclined to grant the petitioner the privilege of anticipatory bail.

8. This application for anticipatory bail is, accordingly, allowed.

9. Let the petitioner, named above, in the event of their arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1^st Class, Gopalganj/Successor Court in connection with aforesaid Police Station Case subject to the conditions as laid down under Section 482 (2) of the B.N.S.S. 2023, as well as the following conditions:-

(i) one of the bailors should be the family member/relative of the petitioner(s) who shall provide official document to show his/her bona fide;

(ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
