2 17-02-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The accused-petitioner, named in the F.I.R., is apprehending his arrest in connection with Bettiah Town (Nagar) (Kalibagh O.P.) P.S. Case No. 630 of 2018 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

3. As per FIR, petitioner alleged to receive total cash of Rs. 31,00,000/- (Thirty One Lakhs) against a piece of land, which was promised to sell to the informant.

4. Learned counsel appearing on behalf of the petitioner submitted that no such amount was ever paid to the petitioner and merely on the basis of oral agreement and cash payment, the present allegation was raised against the petitioner. It is submitted that the cheque in issue was not issued by this petitioner.

5. Learned counsel further submitted that informant is a habitual to lodge false case and, in support of his submission, learned counsel pointed out Annexure P/2 series. While concluding argument, it is submitted that the dispute is purely of civil nature arising out of sale/purchase dispute of land. Petitioner found involved in one more case of similar nature, in which he is on bail.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

7. In view of the aforesaid factual submissions and by taking note of the fact as dispute primarily appears civil in nature arising out of sale and purchase issue of land, accordingly, above-named petitioner, in the event of his arrest/surrender within a period of four weeks from this order, is directed to be enlarged on bail on furnishing of bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah at West Champaran/concerned court in connection with Bettiah Town (Nagar) (Kalibagh O.P.) P.S. Case No. 630 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita (in short “B.N.S.S.”).
