2. The petitioner claims to be the Chairman of the School Education Committee, Government Middle School, Madhuban “Girls” East Champaran has approached this Court for the following reliefs :-

“i. Issuance of a direction, order or writ, including writ in the nature of certiorari quashing the Office order vide Memo No. 2048 dated 09.04.2025 as well as amended Office order vide Memo No. 2447 dated 28.06.2025 issued by the District Education officer, Motihari. ii. Issuance of a direction, order or writ, including writ in the nature of mandamus commanding the concerned respondent authorities to forthwith make a fresh inspection regarding comparative distance of Government Middle School Madhuban "Girls" and Government Middle School Madhuban "Boys" from the High School Madhuban, East Champaran, which is selected under the P.M. Shri Vidyalaya scheme.

iii. Issuance of a direction, order or writ, including writ in the nature of mandamus commanding the concerned respondent authorities as not to bring in effect the Office order vide Memo No. 2048 dated 09.04.2025 as well as amended Office order vide Memo No. 2447 dated 28.06.2025 passed by the District Education Officer, Motihari till the final adjudication of issue in this present writ petition.

iv. Issuance of a direction, order or writ, including writ in the nature of mandamus commanding the concerned respondent authority to dispose of the Representation of Petitioner with a detailed reasoned order.

v. Issuance of any other appropriate writ(s), order(s), direction(s) as may be deemed fit and proper in the facts and circumstances of the case.”

Learned Advocate for the petitioner, Mr. Pratik Kumar, submits that the merger of the Government Middle School, Madhuban (Girls) with the High School Madhuban, East Champaran selected under the P.M.Shri Vidyalaya Scheme is based upon an incorrect physical verification of the distance of the school, causing severe prejudice to the students and the schools. It is submitted that the Government Middle School Madhuban (Girls), located in the heart of Block Madhuban has the highest involvement of girls from Dalit, Mahadalit, Minority and Extremely Backward Classes and is connected to mainstream education. Merging this school could isolate girls of Dalit, Mahadalit, Minority and Extremely Backward Classes from mainstream education, which would be contrary to the Government’s vision of educating girls. It is further contended that for redressal of the grievance, entire facts have been brought to the knowledge of the authorities concerned. The petitioner has also approached before the District Education Officer, East Champaran, Motihari alongwith a public representation, however, till date, the grievance of the petitioner has not been considered, compelling him to approach this Court.
