CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER

2 16-02-2026 Heard learned counsel appearing on behalf of the petitioner and learned counsel for the State.

2. Petitioner has inter alia prayed for following reliefs in the paragraphs No.1 of the writ petition:-

“That this is an application for issuance of a writ in the nature of certiorari to quash the order dated 18.03.2024 passed by learned Member (Judicial), Bihar Land Tribunal, Patna in B.L.T. Case No.60 of 2024 and thereafter an appropriate writ, order or orders, direction or directions may be issued commanding the respondents to measure, demarcate and set free the land of the petitioner from illegal possession and encroachment from the respondent no.5 to 7 appertaining to the land bearing Khata No.824, Plot No.4881/9131, Thana No.195, area 16 decimil out of 20 decimil situated at mauza Maksudpur, Karariya, Anchal Dumari Katsari, District- Sheohar by disposing of the land measurement case no.20/2022-23 and the petitioner further prays for any other reliefs for which the petitioner is found to be entitled in the fact circumstances of the case.”

Petitioner is aggrieved by the deliberate inaction on part of the Circle Officer, Dumri Katsari, Sheohar, who deliberately has not taken any action to demarcate the land over which the petitioner has filed his application for measurement and measurement case No.20/2022 of 2023 was initiated but till date due to the reason best known to the Circle Officer, he has not proceeded to demarcate the land of the petitioner in spite of several adjournments having been sought on his behalf.

4. It has been informed by learned State Counsel that police force is required.

5. The Superintendent of Police, Sheohar is directed forthwith today to arrange police force and ensure that the petitioner, the Circle Officer, Anchal Amin concerned and private respondent no.5 to 7 are present on the spot, so that in peaceful manner, the demarcation work can be carried by the officers.

6. In case respondents no.5 to 7 disturb or indulge in any criminal activity, then in that case, forthwith they should be taken into custody after lodging of an FIR against them or in alternative, if the petitioner is engaged in such activity.

7. The State officials are required to abide by the rule of law. Ours is a welfare State and right of a citizen is paramount which requires urgent action by all the authorities.

8. The District Magistrate, Sheohar is directed to submit a report before 03:30 p.m. today in respect of the relief as prayed for in the present writ petition, under the circumstances that the writ petition is pending for nearly two weeks. The report is required to be sent electronically to the learned counsel for the State.
