CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER

2 26-02-2026 1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Khizersarai Police Station Case No. 231 of 2025, disclosing offences under Sections 126(2), 115(2), 109, 352, 351(2), 3(5) of the BNS, 2023 and Sections 66 ( C )(D), 67 of the I.T. Act.

3. As per the FIR lodged by a lady alleging that the petitioner was regularly sending obscene videos and messages on informant's mobile registered in her husband's name and blackmailed the informant. The petitioner used to arrive in drunken condition near the house of the informant and used to abuse in order to defame her. The petitioner further circulated informant's video in the village and have made a fake account on Facebook and uploaded obscene status. When informant's family read vulgar comments made on the Facebook ID against the informant, they inquired and found that the petitioner was using the same ID. On 22.06.2025, informant's family members saw that the petitioner was uploading the obscene video and confronted him but they were assaulted.

4. Learned counsel for the petitioner submits that in the FIR, the date of occurrence has not been mentioned. The allegation of creating false ID of the informant and further circulating obscene videos on social media is not correct. The photograph annexed as part of the FIR does not show any objectionable thing. Accused Chitranjan Kumar has been granted anticipatory bail by the learned Lower Court.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation made in the FIR and the fact that the informant is a lady and there is direct allegation against the petitioner, the case of the petitioner is not at par with the case of the co-accused who has been granted anticipatory bail by the learned Lower Court, I am not inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, rejected.
