3 25-02-2026 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 379 of the Indian Penal Code.
3. The case of the prosecution, in brief, is that some unknown persons allegedly stolen the truck belonging to the informant. The F.I.R. was initially lodged against unknown miscreants.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in connection with the present case. During the course of investigation, one Chandan Kumar gave his confessional statement, in which the names of several persons surfaced, including that of the present petitioner. It is further submitted that, upon perusal of the confessional statement of Chandan Kumar, it appears that he allegedly sold the stolen truck to this petitioner.
5. Learned counsel for the petitioner contends that nothing has been recovered from the possession of the petitioner. It is further submitted that similarly situated co- accused persons have already been granted bail by a learned Co- ordinate Bench of this Court vide order dated 01.12.2023 passed in Cr. Misc. No. 75171 of 2023. The case of the present petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 19.09.2025.
6. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has two criminal antecedents.
7. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dhanarua P.S. Case No. 456 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, Masaurhi, Patna.
