6 23-02-2026 I.A. No. 1 of 2026 Heard learned counsel for the appellant and learned Additional Public Prosecutor for State.

2. This interlocutory application has been filed seeking grant of provisional bail for one month to the appellant to enable him to perform the marriage ceremony of his daughter in his village.

3. The appellant has been convicted vide judgment dated 21.12.2024 and sentenced vide order dated 07.01.2025 by out of Fatuha P.S. Case No. 56 of 2016 for the offences under Sections 302/149, 307/149, 427/149 of the Indian Penal Code (in short ‘IPC’) and Section 27 of the Arms Act. He has been ordered to undergo life imprisonment and to pay a fine of Rs.10,000/- for the offence under Section 302/149 IPC. For the sake of brevity, the sentences awarded under other sections are not mentioned.

4. It is stated that the marriage of the daughter of the appellant is fixed for 25.02.2026.

5. Mr. Satya Narayan Prasad, learned Additional Public Prosecutor for the State has sought instructions from the concerned police station. A copy of Letter No. 974 dated 20.02.2026 addressed to him by the Sub Inspector of Police, Nadi Thana, Patna has been placed before this Court. Report is that the reason shown by the appellant has been verified and it has been found correct.

Having regard to the reason shown and the report which has been placed before us by the learned Additional Public Prosecutor for the State, considering the fact that the appellant is the father who has to perform marriage ceremony of his daughter, we suspend his sentence and grant him provisional bail for a period of ten days from today on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Case No. 56 of 2016. One of the bailors shall be his family member having sufficient surety.

7. The appellant shall surrender in the learned trial court on 06th March, 2026 during court hours and shall file the surrender certificate in this Court immediately thereafter. 8. The Senior Superintendent of Police, Patna and the Station House Officer, Nadi Police Station, Patna shall ensure by placing an adequate number of security personnel that the appellant does not leave his village during this period and in no way, he should get in touch with the family of the victims and the witnesses.

9. Let the report be taken on the record.

10. The order shall be communicated to the learned trial court, the office of Senior Superintendent of Police, Patna and the S.H.O. Nadi Police Station, Patna immediately through FAX and email.

11. I.A. No. 1 of 2026 stands disposed of.

12. List this case on 11.03.2026.
