2 26-02-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 137(2), 140(3) of the B.N.S., 2023.

3. Learned counsel for the petitioner has submitted that earlier the bail petition of this petitioner was rejected vide order dated 06.08.2025 with a liberty to the new prayer for bail after six months if the trial is not concluded.

4. Learned counsel for the petitioner has further submitted that recently vide order dated 11.02.2026 the learned trial court has rejected his bail petition and has also recorded that in this case two witnesses have been examined.

5. The case of the prosecution, in short, is that the son of the informant was kidnapped by the petitioner and others and later on he was killed.

6. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that in this case, the petitioner and one Niwas Singh has given their confessional statement and from the confessional statement, it is clear that the deceased was having relationship with the daughter of Niwas Singh. It has been further argued by the learned counsel for the petitioner that the daughter of Niwas Singh was married but after marriage, this petitioner has made video viral and this was the motive why he was being kidnapped. From perusal of the confessional statement which is at paragraph nos. 45 and 46 of the case diary, it is clear that the dead body was recovered on the disclosure of confessional statement of this petitioner. It is further submitted that period of custody of this petitioner and Niwas Singh differs. Moreover, the petitioner is languishing in judicial custody since

21.07.2024.

6. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Pipariya P.S. Case No. 68 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-Vth, Lakhisarai.
