2 25-02-2026 Heard learned counsel for the petitioners and learned APP for the State.

2. The instant application for anticipatory bail has been filed by the petitioners apprehending his arrest in a case instituted for the offence punishable under Sections 126(2), 118(1), 109, 3(5), of Bharatiya Nyaya Sanhita.

3. As per prosecution case, the allegation against the petitioners and others is that they assaulted the informant and her husband by means of knife due to which she and her husband sustained injuries.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. The informant and the petitioners are agnates and due to village politics they have falsely been implicated in this case. Prior to the incident, a case was also lodged against the petitioners which is going on in Raxaul P.S. Case No. 299 of 2025.

5. Learned counsel for the informant opposed the bail application of the petitioners, however, he is not in a position to show the injury sustained by the injured.

6. Learned A.P.P. for the State has vehemently opposed the prayer of bail.

7. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from the date of receipt/production of this order and in the event of his arrest or surrender in connection with Raxaul P.S. Case no. 308 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Raxual at Motihari, East Champaran, subject to the conditions as laid down under section 482 of Bharatiya Nagrik Suraksha Sanhita (BNSS).
