ORAL JUDGMENT

(Per: HONOURABLE THE CHIEF JUSTICE)

Date : 20-02-2026 The petitioner (Sayad Abid Hussain) has filed this writ petition seeking for following reliefs:-

“a. for issuance of an appropriate writ for directing the respondent’s authorities to investigate and inquire the irregularities in procurement of paddy (Rice) through farmers.

b. for commanding the respondents to hold enquiry into the alleged malpractice by the authorities concerned in allotting the benefit under the said scheme to the persons not deserving for same and depriving the genuine beneficiaries and to take suitable action against the persons responsible in accordance with law.

c. for directing the respondents to grant the benefit of subsidies under PACS (Primary Agriculture Credit Society) for procurement of paddy from genuine and deserving farmers/persons d. for direction upon the answering respondents to follow the guide lines as prepared for procurement of paddy as per guidelines issued by Food and consumer protection department Govt. of Bihar (Annx-P/1)

e. for issuance of an appropriate writ for commanding the respondents to act in accordance with law.”

Learned senior counsel appearing for Bihar State Food and Civil Supplies Corporation Ltd. placed Annexure-P/1 submitted that a detailed guidelines have been issued for the Kharif Season 2023-2024, which season is already over since long and, moreover, in the writ petition, no specific instances have been given and the averments are vague in nature. Therefore, the petitioner is not entitled to get any reliefs as sought for.

3. On perusal of the petition, we are also of the view that not only that Kharif season is over but also the averments are vague in nature. No specific instances have been given that which are those persons, who have been deprived of getting the benefits, as provided by the Government, as per Annexure-P/1 and what set of specific irregularities have been committed and by which authorities.

4. In absence of such specific instances, it is difficult to grant any kind of relief to the petitioner. Accordingly, the writ petition stands disposed off.
