5 20-02-2026 Learned counsel for the respondent submits that for non compliance of the impugned order dated 13.02.2025 passed by the learned Single Judge in CWJC No. 17324 of 2024 contempt petition being M.J.C No. 2003 of 2025 has been filed in which an affidavit has been filed by the Engineer-in-Chief, Road further submits that when the matter was taken up on 19.09.2025 the Engineer-in-Chief, Road Construction comply with the order dated 13.02.2025 passed in CWJC No. 17324 of 2025. He has produced some orders passed in M.J.C No. 2003 of 2025, which is kept on record.

2. Learned counsel for the State-appellant on the other hand has placed the operative part of the impugned order, which reads as follows:-

“22. Accordingly, I set-aside and quash the impugned order contained in Memo No. 1959 dated 21.12.2022 and the order contained in Memo No. 275 dated 20.03.2023, the petitioner becomes entitled for entire salary due to him for the period from 01.12.2000 to 26.02.2003 and again from 04.09.2003 to 31.07.2006 and also becomes entitled for the consequential relief which requires fixation of his pension on the basis of pay-scale applicable to him in accordance with law.”

3. He further submits that the arrears of salary due to the writ petitioner for the period from 01.12.2000 to 26.02.2003 and 04.09.2003 to 31.07.2006 have already been paid. Consequently, this Letters Patent Appeal is limited to the second part of the order, which directed that the writ petitioner is entitled to consequential relief involving the fixation of his pension based on the pay scale applicable to him in accordance with law.

4. In the show cause filed by the State in M.J.C No.

2003 of 2025, specifically at paragraph no. 4, it is stated that the respondent has allowed the payment of difference in salary for the period from 01.12.2000 to 26.02.2003 and from 04.09.2003 to 31.07.2006.

5. List this matter on 23.02.2026.
