38 20-02-2026 On 16.01.2026, when this matter was taken up, after noticing the provisions under Article 243-W of the Constitution of India which deals with the power, authority and responsibilities of Municipality, Section 345 of Bihar Municipal Act, which deals with the Municipal licence for sale of flesh, which relates to construction and maintenance of municipal markets and slaughter houses and regulation of all markets and slaughter houses and particularly in view of the provision under provision of Municipal Markets and Slaughter Houses, we asked the Chief Municipal Officer to file an affidavit indicating the steps taken for making the provision of slaughter houses in different Wards of Patna.

2. In pursuance of such order, on behalf of Respondent Nos. 5 and 6, eighth supplementary counter affidavit has been filed by Yash Pal Meena, Chief Executive Officer (Municipal Commissioner), Patna, wherein it is stated in paragraph nos. 2 to 4 as follows:

“2. That it is humbly stated that pursuant to the aforesaid order dated 16.01.2026 passed in the instant matter, the Chief Municipal Engineer, PMC by his letter no.2146 dated 30.01.2026 directed all the Executive Officers and the Executive Engineers of the PMC to ensure to make available the reports in compliance with the directions contained in paragraph nos.6 and 7 of the order dated 16.01.2026 passed in CWJC No.8054/2022.

3. That thereafter by letter no.2533 dated

05.02.2026 the following directions have been issued by the Chief Municipal Officer, PMC to all the Executive Officers of PMC:

1. After conducting survey related to the slaughter house operated under PMC area, reports will be made available within 02 (two)

working days.

2. A survey will be conducted also regarding the selection of sites for construction of new Slaughter Houses in PMC area and reports will be made available within 02 (two) working days.

4. That survey has not yet been fully completed and therefore some more time should be allowed in order to comply the directions as contained in paragraph nos.6 and 7 of the order dated 16.01.2026.

3. The learned counsel appearing for the Respondent Nos. 5 and 6 submits that in view of such affidavit filed by the Municipal Commissioner, some more time may be granted to apprise the development made in this respect.

4. As prayed for, list this matter on 20.03.20206.

5. Learned counsel shall file further affidavit on behalf of Respondent Nos. 5 and 6, in the meantime.
