1. This Interlocutory Application, under Section

430(1) of the Bharatiya Nagarik Suraksha Sanhita (B.N.S.S.), 2023, has been filed on behalf of the Appellant No. 3, Guddi Yadav, praying for temporary suspension of sentence, i.e., for interim bail, for a limited period of time on account of marriage of his only daughter.

2. We have heard the learned Advocate on behalf of the appellant and the learned Advocate for the State.

3. Learned SPP submits that the prayer is on the ground that the marriage of the daughter of the Appellant No. 3 is fixed on 21^st February, 2026 is correct and genuine. 4. In this regard, we have considered the provision of Section 31(C) of the Prisoners Act as well as Home Special Department Notification No. 2 of 2004, dated 24^th January, 2004 which runs thus:-

5. Thus, the District Magistrate has the authority to temporarily release the appellant on parole on account of marriage of his daughter. When the District Magistrate has failed and neglected to discharge his statutory duty, the Court has no other alternative but to come forward to pass necessary order.

6. In view of the ensuing marriage of the appellant’s daughter, the appellant, namely, Guddi Yadav may be released on provisional bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with
