10 18-02-2026 The instant contempt petition is said to have been filed in the year 2019 and today when this matter was taken up for consideration, counsel for the State has taken this Court to an office order contained in Memo No. 77 dated 15.06.2020, which is said to have been passed, in which the reference of certain amendments in the Rules are being shown, creating hindrance for the authorities in carrying out the orders passed by this Court and as also there being no vacancy for appointing this petitioner as against the post for which the direction is said to have been issued by the Appellate Authority in Appeal No.

39 of 2010.

2. It is very surprising that the order passed by the District Appellate Authority in the year 2014 contained in Memo No. 683 dated 22.01.2014 has not been implemented and the petitioner was coerced to take recourse of filing the instant writ petition pursuant to which the Co-ordinate Bench had issued directions, which has not been carried out leading to filing of instant contempt petition.

3. The plea, which is being taken by the opposite parties are contemptuous in nature and, as also, against the directions issued by the Additional Chief Secretary, Department of Education as contained in Memo No. 580 dated

11.03.2019.

4. Accordingly, the Additional Chief Secretary, Department of Education is directed to take a call and initiate proceedings strictly in consonance with the direction issued from his end, wherein the departmental proceedings are required to be initiated against the erring officials for having violated the orders of the Appellate authority created under the statute, which has attained finality and there is no appeal filed by either parties, including the authorities of the Department of Education.

5. It is expected that the Additional Chief Secretary, Department of Education will personally look into the matter and ensure compliance of the order passed by this Court, which is under contempt, within a period of four weeks, and appropriate actions would be taken against the persons, responsible for violating the directions of the appellate forums, shall also be brought on record for consideration.

6. Let this case be listed on 18.03.2026.
