IN THE HIGH COURT OF JUDICATURE AT PATNA
Sourendra Pandey, J
Sunita Kumari
CRIMINAL MISCELLANEOUS No.6976 of 2026
For the Appellants/Petitioners: Sanjay Kumar
For the Respondents: Raj Kishor Singh, Arvind
Anticipatory bail may be granted in cases of alleged fraudulent appointment if there is a significant delay in lodging the FIR and the accused has already been terminated from the service.
Headnote:The case involves allegations under Sections 420, 467, 468, 471, and 120(B) of the Indian Penal Code, where the petitioner is accused of producing a fake intermediate mark-sheet to obtain an appointment as a Niyojit Teacher. The court noted that the appointment occurred in 2010 and the FIR was lodged after nearly ten years, and the petitioner has already been terminated from service. The primary issue is whether the petitioner is entitled to anticipatory bail given the nature of the fraud. The court reasoned that considering the facts and circumstances, including the delay in the FIR and the petitioner's current employment status, the prayer for bail should be granted. Accordingly, the prayer for anticipatory bail is allowed.
