3 17-01-2026 Heard learned counsel for the petitioner, learned counsel for opposite party no. 2 and learned APP for the State.

2. The petitioner has filed the instant application for grant of regular bail in connection with S.K. Puri P.S. Case No. 12 of 2024 registered for the offences punishable under Sections 341, 323, 504, 427, 447, 385, 379, 406, 420/34 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

3. As per allegation in the FIR, informant is the owner of a plot at Anandpuri, West Boring Canal Road, Patna purchased in year 1999. He had constructed apartments and duplex through his Company over the said land. When he attempted to reconstruct the boundary wall over the said land, local muscleman, namely, Akhilesh Kumar with his associates including the petitioner demanded Rs. 90 lakh as extortion. It is further alleged that Rs. 15 lakh was transferred in three accounts, out of which Rs. Five lakh was transferred in the account of the present petitioner.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner has never interacted in any manner with the informant. He has no concern either with the land in question or with with co- accused Akhilesh Kumar. Only allegation against the petitioner is that on instruction of co-accused Akhilesh Kumar, Rs. Five lakhs was transferred in the account of the petitioner, to which he is ready to return.

5. Learned counsel for the petitioner has submitted that he is ready to return the amount of Rs. 5,00,000/- allegedly to be taken in his account by the informant as per FIR. He further submitted that at the time of filing bail bond, he will give Rs. 3,00,000/- to the informant and so far as remaining amount of Rs. 2,00,000/- is concerned, he will give to the informant after his release in two equal monthly installments.

6. Learned counsel for the informant has submitted that she has no objection in respect of mode of payment.

8. Having heard learned counsel for the parties and considering the fact that petitioner is ready to return RS.

5,00,000/- to the informant, this Court is inclined to enlarge him on provisional bail. The above named petitioner is directed to be enlarged on provisional bail in connection with S.K. Puri P.S. Case No. 12 of 2024 on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Patna.

9. At the time of filing bail bond, petitioner will show deposit receipt of Rs. 3,00,000/- before the learned trial court with an affidavit in respect of payment of remaining amount i.e.

of Rs. 2,00,000/- within a period of two months.

10. Trial Court is directed confirm the provisional bail granted to the petitioner after verifying the deposit receipts of entire amount i.e. Rs. 5,00,000/- (Rs. Five Lakh) by the petitioner in the account of the informant.

10. Accordingly, the instant application stands disposed off.
