9 16-03-2026 Heard the parties.
2. The present petition has been preferred for the following relief(s):
“(i) To issue a writ of certiorari for setting aside/quashing the order dated 14.11.2024 passed in Settlement Cancellation Case No. 21/2024 by the District Magistrate-cum-Collector, Kishanganj whereby settlement of the land in Plot No. 41, 44, 45, 46, 47 & 48 in Mauja Bhelaguri, Thana and Block Tedhagacch, District Purnea presently Kishanganj vide Land Settlement Case No. IIT/1958 59 has been cancelled and thereafter the direction was given that the name of settle from the connected Jamabandi may be deleted and a new Jamabandi in the name of State of Bihar for the said land may be created, the possession of the state of Bihar over the said land shall be ensured and the proposal for the settlement of the said land in favour of other enabled persons except the Petitioner shall be sent expeditiously as much as possible.
(ii) To issue an appropriate writ/writs and/or direction/directions to the respondents to give compensation for the land measuring area 01 Acre 25 Decimal and 400 Sq. Kari from Khata No. 18/23, Khesra No. 45, 46 and 47 under Mauza Bhelaguri, Block Tedhagach, Thana No. 125, District Kishanganj which has been acquired under Land Acquisition Case No. 05/2019-20 in project "Araria - Galgalia New BG Rail Line" and the petitioner has not been given single penny as the compensation for the said acquisition; (iii) For the direction/directions to the Respondents to give opportunity a fresh to the petitioner to challenge the process of fixing the compensation amount followed by the opportunity to enhance the compensation so fixed and paid as per the provisions of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 (the Act for the sake of brevity);
(iv) For the direction/directions to the Respondents not to acquire the land without giving proper compensation under the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013;
(v) To issue any other writ/writs and/or direction/directions to the respondents as your Lordships may deem fit and proper in the facts and circumstances of the case.”

3. The aforesaid Interlocutory Application has been preferred for addition of Baratu Harijan son of late Kalu Harijan, Resident of Farabari, P.S. Tedhgacch, District –
Kishanganj as respondent No. 9 in the original petition.
4. There is no opposition from the other side.
5. In the fitness of the thing, it would be appropriate that the present Interlocutory Application is allowed.
6. Accordingly, I.A. No. 01 of 2026 stands disposed of.
7. Let the name of Baratu Harijan son of Kalu Harijan be incorporated in the list of respondents as respondent no. 9.
8. Office to do the needful.

9. Issue notice to the newly added respondent no. 9, Baratu Harijan through both processes i.e. ordinary as well as registered cover with A/D for which requisites etc. must be filed within a period of two weeks failing which the application shall stand rejected without further reference to the Bench.
10. In case, the order passed is not complied and the matter accordingly stands dismissed, subsequently, the same be posted under the heading ‘To be Mentioned’.
11. List this case on 11.05.2026.
