20 10-03-2026 Heard the learned counsel for the parties.

The present writ petition has been filed for the following relief(s):-

“(i) For issuance of writ in the nature of mandamus for a direction to the respondent authorities to execute agreement with the petitioner in the light of the Gyapank No. 981 dated 17.08.2024 whereby and whereunder work for Door Step Delivery Transportation of Food Grains has been allowed to the petitioner in the light of decision taken in the meeting dated

16.08.2024 by the Chaiman-cum-District Magistrate, District Transport Committee, East Champaran.

(ii) For a direction to the respondent authorities to allot the work for Door Step Delivery Transportation of Food Grains to the petitioner.

(iii) For any other relief/ reliefs if the petitioner found entitled in the facts and circumstances of the present case.”

3. Thereafter, the petitioner has filed an I.A. No. 02 of 2026 seeking amendment of the relief portion and the same is allowed. The amended prayers are as follow;

“(i) For issuance of appropriate writ/ writs, order/ orders, direction/ directions for quashing the memo no. 69 dated 13.01.2026 issued under the signature of District Magistrate (Respondent No. 2) whereby and whereunder a decision has been taken to circulate a fresh tender for selection of DSD Contractor within the District of Motihari and further affirmed the decision of 02.04.2025 whereby a decision was taken to remove the petitioner from panel.

(ii) For issuance of appropriate writ/ writs, order/ orders, direction/ directions commanding the respondent authorities to allow the petitioner to discharge the assignment of DSD Contractor pursuant to his shortlisting vide memo no. 981 dated 17.08.2024 (Annexure-P/4) whereby petitioner has been shortlisted for assignment of DSD however agreement for DSD Contract work has been kept pending till decision of DSD Contract work of husband of petitioner who was at one point of time were blacklisted without any fault on his part and now District Transport Committee, Muzaffarpur rescinded the order of blacklisting of husband of petitioner vide memo no. 1943 dated 18.11.2025 and as such it is just and proper that petitioner may be allowed to work as DSD Contractor within the District of East Champaran, Motihari.

(iii) For issuance of any other relief/ reliefs for which petitioner is found entitled in the eye of law and in the facts and circumstances of the present case.”

4. It is the case of the petitioner that pursuant to the tender floated by the authority for empanelment of Door Step Delivery Transportation of food grains (DSD Transportation) for the District of East Champa
