The learned counsel for the respective parties are present.

2. The learned Additional Advocate General No. 4 submits that even though it was brought to notice of this Court by way of an affidavit filed by one Vineet Kumar Bageria, Deputy General Manager of NHAI that there is hindrance in executing work for about 500 meters in Belachand Sukhiya, Mauza of Purnia district for which District Administration has been requested to provide police assistance but he has ascertained that there is no such issue and it has been resolved and the NHAI can freely execute the work assigned.

3. The Additional Advocate General, however, further submits that as per the order dated 12.02.2026, necessary police protection has been provided to the NHAI.

4. Dr. K.N. Singh, learned senior advocate appearing for the NHAI submits that the work of 500 meters in Belachand Sukhiya, Mauza of Purnia district is under progress and it is likely to be completed soon and the expected date of the completion of the entire package is 30.07.2026 and the package- 2 of the highway project is likely to be completed by

30.04.2026.

5. Even though the submission was made by the learned counsel appearing for the respondent no. 7 on the last date that an affidavit is to be filed regarding non-payment of some amount but the same could not be done. However, learned counsel submits that she has filed a supplementary counter affidavit on behalf of the respondent no. 7, through online on

17.02.2026, and produced hard copy before us.

6. Let that copy be placed on record.

7. From the supplementary counter affidavit, it appears that so far as the Rehabilitation & Upgradation of Two Laning of Maheshkhunt – Saharsa- Purnea Section of NH-107 (Package-II) is concerned, the physical progress is 90% and the financial progress is 85.20%.

8. The learned counsel for the respondent no. 7 seeks some more time to obtain the outstanding dues against the NHAI for the completed work.

9. List both the matters on 01.05.2026.
