2 13-03-2026 1. Heard learned counsel for the petitioners, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.

2. The learned counsel for the petitioners, at the outset, seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 1 (Ajit Kumar) who was arrested during pendency of the same.

3. Permission is accorded.

4. The petitioner nos. 2 and 3 apprehend their arrest in a case registered for the offences punishable under Sections 406, 420, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner nos. 2 and 3 are persons with clean antecedent and the informant alleges that he had a talk with Ajit and Nitu for purchasing 18 Katha, 15 dhur land at village Bachhwara, the talk was carried in presence of Lutan, Manikant and Lutan Rai and money was also transferred in their presence, further an amount of Rs. 3,31,000/- and Rs. 2,50,000/- was transferred in the account of Ajit from account of his son, Rakesh on 04.02.2023 and 05.04.2023, thereafter an amount of Rs. 2 Lakhs was transferred in the account of Ajit from account of Manish who is son of the brother of his wife and Rs. 6,19,000/- was given in cash to Ajit by Vikash, son of the informant, but the sale deed was not executed and in the process the informant was duped of his money totaling Rs. 16 Lakhs including the money which was paid earlier as recorded hereinabove.

6. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that thrust of the allegation is against Ajit. It is also submitted that no amount was ever credited in the account of Nitu and Rajendra. It is also submitted that since Nitu is wife of Ajit, as such, she also came to be implicated with a view to coerce Ajit into submission. It is next submitted that Rajendra was the mediator, as such, he has no role to play nor any amount was credited in his account. It is reiterated and submitted that Ajit has been arrested.

Learned A.P.P. for the State as well as the learned counsel appearing on behalf of the informant opposes the anticipatory bail application of the petitioners, but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioners that no amount of money was credited in the account of the petitioners and the thrust of the allegation is against Ajit.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial c
