Heard learned Counsel for the appellant and learned

Counsel for the State.

Through I.A. No. 2035 of 2012, the appellant

Dharmendra Yadav has renewed his prayer for bail on the ground

that other two convicts Gorelala Yadav @ Parmanand Yadav and

Anjan Yadav have been granted bail (in Cri Appeal (DB) No. 406

of 2009) on 21.11.2012 and 14.12.2012 respectively (Annexure-

1).

From order dated 21.11.2012, it appears that in view

of observation dated 27.01.2012 and in view of statement of

appellants that they have completed more than five years in

custody and this appellant has also completed more than five years

in custody.

Considering the facts and circumstances, during the

pendency of the appeal, the appellant Dharmendra Yadav is

ordered to be released on bail on furnishing bail bond of Rs.

10,000/- (Ten Thousand) with two sureties of the like amount each

to the satisfaction of the learned Additional Sessions Judge, Fast

Track Court No. IV, Gaya in connection with Sessions Trial No.

125 of 2008 / 471 2008.

Thus, I.A. No. 2035 of 2012 stands allowed.
