HIGH COURT OF PUNJAB AND HARYANA
Harsimran Singh Sethi, J
Faquir Chand Sheokand and others – Appellant
Versus
State of Haryana and another – Respondent
CWP No. 12209 of 2024
For the Appellants/Petitioners: Virender Singh Punia
For the Respondents: Harish Nain
Service disputes must be raised within a statutory limitation period, with delays rendering petitions non-maintainable.
Headnote:The present petition challenges the withdrawal of step up of pay benefit granted to the petitioners through an order dated 12.09.2011. This action has been deemed arbitrary by the petitioners, arguing entitlement based on similar treatment to other employees. The respondents contest this on procedural grounds, emphasizing a 12-year delay in filing the petition, which they claim renders the case non-maintainable. The court, referencing precedents, establishes that service disputes must be pursued timely, confirming that the petition is barred by limitations as per statutory provisions. Final ruling: Dismissed.

1. In the present petition, the challenge is to the order dated 12.09.2011 (Annexure P-1) by which the benefit of step up of pay granted in favour of petitioners has been withdrawn. The further challenge is to the order dated 25.01.2023 (Annexure P-2) by which, the petitioners have been informed that their claim for step up of pay has already been rejected in the year 2011.
2. Learned counsel for the petitioners argues that the withdrawal of benefit of step up of pay is arbitrary and illegal as the same benefit has been extended in favour of the other similarly situated employees and hence, the petitioners are also entitled for the said benefit.
