The defendant is in second appeal against the concurrent judgments and decrees of the learned Courts below, whereby the suit of the plaintiff/respondent herein, for recovery of Rs. 5,83,609.01 (Rs. 4,86,341.01 paise on account of principal amount and Rs. 97,268/- on account of interest), has been decreed by both the Courts below. The learned trial Court held that although the plaintiff had claimed interest @ 12% per annum with effect from 30.12.2006 till the date of decree; plaintiff was allowed interest @ 9% per annum from 30.12.2006 to the date of decree and further interest @ 6% per annum from the date of decree to the date of payment.
