By the nature of order that I propose to pass, I

dispense with notice to the respondents. The husband has filed a

petition for divorce under Section 13 and the wife has filed a petition

for restitution of conjugal rights under Section 9 of the Hindu

Marriage Act. The application filed for consolidating both the cases

together for a common trial pending before the same Court has been

rejected on the ground that averments in the respective petitions are

not the same. The reasoning of the Court is totally erroneous. The

decision of whether the wife is entitled to restitution even when the

husband is asking for divorce
