CM-2125-LPA/ 2013:

The appeal has been filed after a delay of 458 days which is

more than a year and a quarter. The reasons for condonation of delay

are the normal government lethargy other than the fact that initially the

office of the Advocate General opined against filing of the appeal and

thereafter the governm ent kept on shuffling the file till opinion was

obtained to file the appeal.

In view of the judgment of the Hon’ble Supreme Court in

Office of the Chief Post Master General & Ors. vs. Living Media

I ndia Ltd. & Anr., 2012 ( 2) S.C.T. 269, we find ground to condone

such inordinate delay.
