IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH CR-7788-2025 (O&M)

Date of Decision: 20.11.2025 Ramesh and others ......Petitioners Vs.

Hardeep Singh and another ......Respondents CORAM: HON’BLE MRS. JUSTICE SUDEEPTI SHARMA Present : Mr. Sarwinder Goyal, Advocate, and Mr. Nishant Sindhu, Advocate, for the petitioners.

Mr. Vipul Joshi, Advocate, Mr. Piyush Kumar, Advocate and Mr. Sankalp Sharma, Advocate, for respondent No.1.

Mr. Vishal Gupta, Advocate, for respondent No.2.

****

SUDEEPTI SHARMA J. (ORAL)

1. The present revision petition is filed against the orders dated 28.08.2025 and 25.09.2025 passed by the learned Civil Judge (Junior Division), Rupnagar, whereby ad interim injunction has not been granted against the respondents.

2. Learned counsel for the petitioners contends that there is an urgency since the matter pertains to the erection of mobile tower in the residential area and if the interim stay is not granted, the mobile tower would be erected. He further prays that, at this stage, he does not press the present petition. He, however, prays that direction be issued to the learned Civil Judge (Junior Division), Rupnagar, to decide the application under Order 39 Rule 1 & 2 filed by the petitioners, expeditiously, since the matter is adjourned to 08.01.2026.

3. Learned counsel for the respondents contend that they have no objection if the learned Civil Judge (Junior Division), Rupnagar, is directed to decide the application under Order 39 Rule 1 & 2 CPC filed by the petitioners, expeditiously.

4. I have heard learned counsel for the parties and perused the file with their able assistance.

5. A perusal of the file and the impugned orders shows that the present petition is pre-mature since the learned Civil Judge (Junior Division), Rupnagar, is following the procedure in accordance with law before deciding the application under Order 39 Rule 1 & 2 CPC filed by the petitioners.

6. Since the next date fixed before the learned trial Court is 08.01.2026, learned counsel for the petitioners contends that he is in process of moving of application for preponement of the same. In that event, learned Civil Judge (Junior Division), Rupnagar, is directed to decide the application under Order 39 Rule 1 & 2 CPC moved by the petitioners within a period of three weeks thereafter.

7. The present petition is disposed of, accordingly.

8. Pending application(s), if any, also stand disposed of.
