1. The substantive prayer made in the present appeal reads, thus:

“It is therefore humbly most and respectfully prayed that this appeal may kindly be accepted and the impugned order passed by the learned Trial Court dated 04.08.2014 may kindly be set aside and the accused may kindly be commission of the held guilty for the alleged offence under

Section 138 of Negotiable Instrument Act, 1881 the in interest of justice.”

Alongwith an appeal, an application for grant of leave has also

been preferred under Section 378(4) Cr.P.C., 1973
