1. The present suit was instituted on the allegation that the appellant/defendant borrowed a sum of Rs. 75,000/- from the respondent/plaintiff on 10.11.1993. It was averred that the appellant/defendant had agreed to repay the principal amount along with interest at the rate of 2% per annum and, in furtherance of the transaction, executed a promissory note (pronote) and a receipt in favour of the respondent/plaintiff. Subsequently, upon demand for repayment, the appellant/defendant failed to discharge her liability. Despite service of a legal notice demanding payment, no response or repayment was made. Consequently, the respondent/plaintiff instituted the suit seeking recovery of

the loan amount along with interest, asserting that the pronote and receipt constitute valid and enforceable instruments evidencing the debt.
