CWP-9843-2025 was disposed of vide order dated 22.04.2025 with the following directions:-

3. Accordingly, at this stage, without commenting on the merits of the case, the writ petition is disposed of with a direction to respondent No.2 to take a decision on the representation dated 12.03.2025 (Annexure P- 4), submitted by the petitioners, by passing a speaking order and after affording opportunity of hearing to all concerned, preferably within one month from the date of receipt of a copy of this order.”

2. Compliance report by way of affidavit of Dr. Munish Nagpal, Deputy Commissioner, Charkhi Dadri, filed on behalf of the respondent in the Registry, is taken on record.

3. Paragraph 4 of the said report reads as under:-

“4. That the matter was placed before the then Deputy Commissioner, Charkhi Dadri, Shri Munish Sharma, IAS, who after due consideration in compliance of this said order personally heard all concerned parties on 04-06-2025 and after hearing the parties, the then Deputy Commissioner constituted a Committee of Halka Girdawar and Halka Patwari under the chairmanship of Block Development and Panchayat Officer, Charkhi Dadri to submit the status on present situation on ground and also instructed to submit its report to SDO(C), Charkhi Dadri to comment on findings before 10-06-2025. And in case of encroachment is still found, proceeding for its removal to be initiated by 15-06-2025. The committee inspected the spot on 13-06-2025 and found that spot inspection is not possible without demarcation same was allowed and finally the demarcation of the spot conducted on 11-08-2025 and presented the said report on 21-08-2025 vide memo no. 10165 dated 18-08-2025. According to the said demarcation report 5 new and 12 old encroachers were found on disputed land/passage of Gram Panchayat. Thereafter the then Deputy Commissioner decided the representation of petitioner and directed Assistant Collector 1st grade cum SDO(C), Charkhi Dadri to implement the orders dated 20-12-2006 and 22-01-2020 with immediate effect and within 7 days ensure that the illegal encroachment removed as per demarcation report dated 29-01-2001 and handed over the possession to Gram Panchayat and thereafter submit the compliance report to the office of Deputy Commissioner. Apart from this, the Sarpanch and BDPO Charkhi Dadri are directed to proceed as per law against the new encroachment shown on the basis of demarcation report dated 11-08-2025. Hence the order dated 22-04-2025 has been complied in its complete letter and spirit. The Block Development & Panchayat Officer, Charkhi Dadri complied the speaking order dated 28-08-2025 regarding removal of encroachment and handed over the possession to the Gram panchayat and send his report vide memo no. 11130 dated 19-09-2025 to the office of deponent. The translated copies of speaking order dated 28-08- 2025 and memo dated 19-09-2025 are attached herewith as Annexure R-1 & R-2 respectively.”

4. The directions, therefore, stand complied with. In view of the same, no further orders are required to be passed by this Court and the instant contempt petition is accordingly disposed of.

5. Pending application(s), if any, also stands disposed of.
