1. This order will dispose of two revision petitions, both filed by petitioner/defendant No.4-Om Prakash. The first revision petition is CR- 3104-2022 in which the challenge is to the order dated 19.07.2022 passed by the First Appellate Court vide which the order passed by the trial Court granting injunction in favour of the counter claimant/petitioner has been set aside. Vide the same order, injunction has been granted in favour of the respondent/plaintiff by the First Appellate Court. The grant of injunction in favour of the plaintiff by the same order dated 19.07.2022 has been challenged by filing a separate revision i.e. CR-3111-2022. In the present case, while issuing notice of motion, interim order was passed and further on 31.07.2023, a coordinate Bench of this Court had directed that status quo would continue.

2. Learned counsel for the petitioner has submitted that the petitioner would be satisfied in case the order of status quo is continued till the time the suit is decided.

Learned counsel for respondent No.1, on the other hand, has submitted that the main case is now listed for rebuttal and arguments on 23.01.2026 and the trial Court be directed to decide the suit expeditiously and in a time bound manner. It is further submitted that the grant of status quo order or the continuance of the same should not be construed as an expression on the merits of the case and respondent No.1 be granted liberty to raise all pleas as are available to the said respondent before the trial Court. 4. A very fair stand has been taken by counsel for the petitioner as well as counsel for contesting respondent No.1 and on the basis of the same, the present revision petitions are disposed of with the following observations/directions:

(i) The order of “status quo” would continue till the time the main suit is decided. The grant or the continuance of the said “status quo” order would not be construed as an expression on the merits of the case and it would be open to the parties to raise all pleas as are available to them before the trial Court.

(ii) Since the suit is of the year 2017 and it is stated to be fixed for rebuttal and final arguments on 23.01.2026, thus, the trial Court is requested to decide the same as expeditiously as possible preferably within a period of four months from the date of receipt of certified copy of the present order.

iii) As undertaken before this Court, the counsel appearing for all the parties in the trial Court would fully assist the Court in expeditious disposal of the case.

(iv) It is made clear that this Court has not opined on the merits of the case.

5. Pending applications stand disposed of.

6. Copy of this order be placed on the file of connected case.
