1. Prayer made in the present petition is for grant of anticipatory bail to

the petitioner in case FIR No.184 dated 02.10.2025, registered at Police Station

Jamalpur, Ludhiana, under Sections 420 and 120-B IPC and Section 24 of

Immigration Act.

2. The contents of the above-mentioned FIR are reproduced herein

below:-

“Today at police station one complaint bearing No. PGD NO

628484/627210 DT 26-07-2025 from Bhupesh Bali Son of

Narinderpal r/o Plot No. 163, Ward No. 10, Guru Nanak Nagar,

Bhamia, Village Kuliyewal, Tehsil & District Ludhiana,

Mobile No.97812-75141 against 1. Kunwarjit Singh Sethi son

of Davinder Singh Sethi 2. Davinder Singh Sethi son of not

known 3. Gurmeet Kaur Sethi wife of Davinder Singh Sethi 4.

605, Guru Nanak Nagar, Kulianwal, Jamalpur, Ludhiana for

duping the complainant to the tune of Rs. 25 lacs on the pretext

of sending his brother Nikhil Bali to abroad and to misuse his

signatures to misuse his cheques and extending threats on the

name of roping me in criminal litigation for doing the

embazlement and for extending life threats and therefore

praying for taking strict legal action against the guilty has been

received.

Sir, 1. That I am permanent resident of above-mentioned

address and living with my family from last 25 years and I am

law-abiding and peace loving citizen. 2. That all the

above-mentioned accused are residents of my neighbourhood

and they are having good terms with my family due to which

we have confidence upon above-mentioned accuseds. That

above-mentioned accused No.1 has started the business of

immigration under partnership in the year of 2023 under the

name of Assureway Immigration in which he had partner

namely Harsh Goyal. There office was located at Ghumar

Mandi, Ludhiana. That my brother namely Nikhil Bali had

decided to settle in abroad and in regard to this I went to meet

accused No.1 at his home in June 2023 and discussed that he

wants to send his brother Nikhil Bali to Abroad and at that time

all other accused were present in the house. Above-mentioned

accused no.1 has stated that he can send brother Nikhil Bali to

Canada on work Permit and he has further stated that the

amount of Rs. 20 to 22 lacs would be incurred for sending him

on work permit to Canada. And I told accused No.1 that I will

let you know after discussing the same at home and I talked to

my family members after reaching home and we decide to send

my brother to Canada after obtaining bank loan. That after this

I told accused no.1 that we will obtain a bank loan and you

should initiate the process of sending my brother abroad on

which accused no.1 has sought all documents of my brother

and stated that he will start the process of procuring work

permit for Canada and will also get you loan on your home and

after obtaining the bank loan you should hand over all the

amount to me and I believed the words of accused no 1. I

handed over all the documents related to my brother t his home

in the presence of other accuseds and accused no.1 got the

documents of my home for obtaining home loan. That in

January 2024 my loan got approved and on 10.01.2024 I

transferred the amount of Rs. 50 thousand through mobile

transfer in the mobile of accused no.1 and handed over the

cheque bearing no. 438580 of Rs. 7 lacs and 3 lac rupees

cheque bearing no. 438581 of SBI which has been encashed on

11.01.2024 in the account of accu
