The applicant, namely, Yashika Chawla as well as Sh. Mohinder

Pal, Attorney holder of the respondent, are present before the court today.

After having interaction with them, both the parties have agreed

for amicable settlement.

As evident from the contents of the application, there was oral

amicable settlement reached between the parties and petition under Section

13-B of Hindu Marriage Act, was filed. Thereupon, statements of first

motion were recorded and an amount of Rs.6,00,000/- and gold articles were

paid to the applicant by the respondent through his attorney holder, namely,

Mohinder Pal. However, subsequently the respondent did not make

appearance for recording of statement of second motion, though it was stated

that it was due to some non-compliance of certain terms of the oral

agreement earlier reached between the parties, which was not stated in the

petition under Section 13-B of Hindu Marriage Act. On this account, the

said petition was dismissed and the divorce petition was thereafter filed by

the respondent, which is now sought to be transferred.

However, after having some interaction today, both the parties

have agreed for divorce by mutual consent and an amount of Rs.22,00,000/-

has been agreed to be paid by the respondent to the applicant and an amount

of Rs.6,00,000/- earlier paid in the petition under Section 13-B of Hindu

Marriage Act, shall be adjusted in the same. Besides the same, gold articles

are also stated to have been received by the applicant from the respondent.

Also, it has been agreed between them residue an amount of Rs.16,00,000/-

shall be paid by the respondent through his attorney holder, namely,

Mohinder Pal, to the applicant at the time of recording of the statement of

second motion, before learned trial Court, in the name of the applicant.

Also, it has been agreed between the parties that the pending litigation

between the parties, shall be withdrawn, within a period of seven days from

today onwards, by filing an application for preponement, before the court

concerned. If any such application for preponement is filed, the court

concerned shall consider the same, in the light of the amicable settlement

reached between the parties and to facilitate the filing of the fresh petition

under Section 13-B of Hindu Marriage Act, within the given time, as agreed.

After the withdrawal of the petition, which is sought to be

transferred, within the next date seven days, counsel for the respondent shall

prepare the petition under Section 13-B of Hindu Marriage Act and also the

applicant who is present before the court today, gives an undertaking to affix

her signatures on the said petition, within the given time and also to make

appearance, with regard to the statements of petition under Section 13-B of

Hindu Marriage Act.

In view of the settlement, so reached, at this stage, counsel as

well as the applicant submit that they do not want to pursue with the present

application and the same be dismissed as withdrawn.

Ordered accordingly.

However, the parties shall remain bound by the statements, so

made and comply with the terms and conditions of the settlement, so

reached.
