1. This application has been filed under Section 151 of the Code of Civil Procedure, 1908 read with Articles 226 & 227 of the Constitution of India for placing on record complete true translated copies of Annexures P-1, P-2, P- 4, P-5, P-7, P-8, P-10, P-13 & reply dated 17.01.2026 (Annexure P-36) to the legal notice dated 06.10.2025.

Present civil writ petition has been filed under Articles 226 & 227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to grant revised pay scale of Rs.140-300 to the petitioners from the date of their initial appointment, at par with the Punjab Government employees, holding the identical posts and qualifications.

Learned counsel for the petitioners, inter alia, contends that the petitioners are working with the respondent-Board as Pump Drivers and Fitters and their services have been satisfactory throughout the period, as there is no adverse remarks against them. Further, the petitioners possess the educational as well as technical qualifications of Matric with two years IT Course, which entitle them for their claim for higher pay scale, as being demanded by them for the last more than 15 years. Moreover, in terms of recommendations of the Pay Commission, pay scales for skilled and semi-skilled posts in various departments of the State of Punjab were rationalized by linking the same to the qualifications in different categories. The aforesaid report of the Pay Commission was implemented by the State of Punjab for grant of pay scale according to the qualifications of its employees. It is further contended that the issue with regard to implementation of recommendations of the Pay Commission was upheld by this Court on 30.05.2008 in CWP-10759-1990 titled as Rajinder Paul Gautam and others Vs. State of Punjab and others. In the said petition, the employees, who were employed as Pump Operators in Public Health Department, Punjab in the pay scale of Rs.110-180, having qualifications of Matric with two years ITI Course, were denied the benefit of revision of pay scale and they were wrongly placed in category (ii) under the categorization of posts. This Court, while applying the principle of ‘Equal Pay for Equal Work’, directed to grant pay scale of Rs.140-300 to the petitioners therein, by considering them under category (iv), which corresponds to the qualification of Matric with two years ITI Course. The State of Punjab preferred an intra-Court appeal i.e. LPA-44-2009 titled as State of Punjab and others Vs. Rajinder Paul Gautam and others and the Division Bench of this Court, vide judgment dated 15.02.2010 (Annexure P-16), upheld the order dated 30.05.2008 passed by the Coordinate Bench.
