IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
VEERPAL KAUR – Appellant
Versus
STATE OF PUNJAB – Respondent

228 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH Date of Decision: 05.02.2026 Veerpal Kaur ..... Petitioner Versus State of Punjab .......Respondent CORAM: HON'BLE MR. JUSTICE RAJESH BHARDWAJ Present: Ms. Jasneet Mehra, Advocate, for the petitioner.

Mr. Ekam Pal Sagoo, AAG, Punjab.

Rajesh Bhardwaj, J. (ORAL)

1. Prayer in the present petition is for grant of regular bail to the petitioner in a case FIR No.65 dated 03.04.2024, registered under Sections 302 IPC (Section 201 IPC added lateron), at Police Station City-2 Mansa, District Mansa.

2. Succinctly, facts of the case are that the FIR in the present case was registered on the statement of the complainant, namely, Sandeep Kuar wife of Harpreet Singh. It was alleged that her brother Hardeep Singh solemnized love marriage with Veepal Kaur (petitioner) in 2016. The complainant’s mother already expired in 2010 and her brother was blessed with a son, namely, Agamjot Singh (since deceased) in 2017. Her brother Hardeep Singh is confined in Bathinda Jail from the last about three years. Her sister-in-law Veerpal Kaur was doing private job at Rama Hospital, Bathinda. It was alleged that her father Harmail Singh was also residing with Veerpal Kaur and her nephew Agamjot Singh. On 31.03.2024, her father went to Jatana Kalan to meet her sister. In his absence, her sister-in-law Veerpal Kaur murdered Agamjot Singh and his dead body was thrown at the Bus Stand, Mansa. On coming to know, she alongwith her Taya Ji reached the hospital and identified the body of Agamjot Singh. It was alleged that her sister-in-law had decided to decimate the family and thus, to get rid of the child, she killed the complainant’s nephew. Thus, request was made to take legal action against the accused person. On the registration of the FIR, the investigation commenced. The petitioner was arrested on 03.04.2024. The petitioner approached the Court of learned Sessions Judge, Mansa praying for grant of regular bail. However, after hearing both the sides, the learned Court finding no merit in the same, dismissed the bail application filed by the petitioner vide order dated 02.05.2025. Earlier also, the petitioner approached this Court by way of filing CRM-M-29449-2025, however, the same was dismissed as withdrawn by this Court vide order dated 01.07.2025. Hence, the petitioner has again approached this Court praying for grant of regular bail by way of filing the present second petition. 3. It has been vehemently contended by learned counsel for the petitioner that the petitioner has been falsely implicated in the present case at the behest of complainant and her sister. It is submitted that the petitioner before this Court is none other than the mother of the deceased child. She submits that Hardeep Singh, i.e. husband of the petitioner is already behind the bars and she had performed love marriage with Hardeep Singh. It is submitted that the petitioner was living with her father-in-law and her son. She submits that in order to take revenge, the petitioner had been roped in the present case on the allegations that she committed murder of her own child. It is submitted that only evidence collected against the petitioner by the prosecution is her alleged extra judicial confession made before her second sister-in-law i.e. Harjeet Kaur. She submits that there was no occasion for the petitioner to make any extra judicial confession before her sister-in-law, who was never a person of her confidence. She submits that the petitioner has no criminal antecedents and the case is based on the circumstantial evidence and the prosecution is bound to complete the chain of evidence, however, the case in hand is virtually a case with no evidence. She, thus, submits that in the overall facts and circumstances, the petitioner deserves to be granted bail.

4. Status report by way of affidavit of Butta Singh, PPS, Deputy Superintendent of Police, Sub Division Mansa, District Mansa, filed in Court is taken on record.
