1. The plaintiff-appellant is aggrieved by the judgment and decree dated 18.12.2025 passed by the learned Additional District Judge, Ludhiana, whereby the appeal preferred by the respondent-defendant No. 2 was accepted and the judgment and decree dated 06.12.2019 passed by the learned Additional Civil Judge (Senior Division), Samrala whereby the suit preferred by the plaintiff-appellant for declaration and possession was decreed, was set aside.

2. The simple case of the plaintiff was that the suit property in the hands of his father, i.e. defendant No. 1 Gurdev Singh, was joint Hindu family ancestral coparcenary property and that the plaintiff-appellant had a birthright therein.
